By accessing or using Lumara ("Platform"), operated by Lumara LLC ("Company"), you agree to be legally bound by these Terms of Service, including the Assumption of Risk and Release of Liability provisions contained herein. If you do not agree, you must immediately discontinue use of the Platform. You represent that you are at least 18 years of age and have the legal capacity to enter into this Agreement.

You must be at least 18 years old to access or use the Platform. By proceeding, you represent and warrant under penalty of perjury that you are 18 years of age or older. The Company reserves the right to request age verification at any time and to immediately terminate accounts that cannot be verified. Access by minors is strictly prohibited and constitutes a material breach of these Terms.

The Platform provides access to artificial intelligence-generated personas ("AI Characters") for entertainment and simulated interaction. You acknowledge and agree: (a) AI Characters are not real people, do not possess consciousness, and do not form real relationships; (b) any perceived emotional reciprocity is simulated and generated algorithmically; (c) the Platform is intended for entertainment purposes only and is not a substitute for human interaction, professional advice, or mental health services; (d) all content may be generated dynamically and may not be accurate, appropriate, or consistent; (e) the service may evolve, change, or be discontinued at any time without notice.

You expressly acknowledge and assume all risks arising from use of the Platform, including but not limited to: emotional attachment, dependency, or perceived bonding with AI Characters; psychological distress, confusion, or altered perception of relationships; social withdrawal or impact on real-world relationships; misinterpretation of AI-generated communications. You understand that such risks may be foreseeable or unforeseeable, and you voluntarily accept full and sole responsibility for them.

The Platform and Company do not provide medical, psychological, or psychiatric services; do not monitor user mental health; and do not intervene in crises or emergencies. You agree that you are solely responsible for your mental and emotional well-being; you will seek licensed professional help where appropriate; and you will discontinue use if you experience distress, compulsive use, or harmful ideation. To the maximum extent permitted by applicable law, you hereby irrevocably and unconditionally release, waive, and discharge Lumara LLC and its officers, directors, employees, agents, affiliates, successors, and assigns from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, suspected or unsuspected, arising out of or related to: emotional or psychological harm; mental health deterioration or crisis; attachment to or reliance on AI Characters; relationship, social, or behavioral consequences; any content generated by the Platform; or any use or misuse of the Platform.

You expressly waive any rights under California Civil Code Section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in their favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You acknowledge that you understand the significance of this waiver and intend to waive unknown claims.

You agree not to use the Platform to: violate any applicable law or regulation; harass, abuse, threaten, or harm others; promote violence, self-harm, or illegal activity; upload or transmit unlawful, defamatory, or infringing content; attempt to exploit, manipulate, or reverse-engineer the Platform or its AI systems; use automated systems without authorization; circumvent security features or access restrictions.

The following content is absolutely prohibited and will result in immediate account termination and reporting to law enforcement: any sexual content involving individuals under 18 years of age or characters of ambiguous or unspecified age; non-consensual sexual scenarios presented approvingly; identifiable real individuals depicted without verified written consent; content facilitating or promoting violence, self-harm, or illegal activity.

Your use of the Platform is governed by our Privacy Policy, incorporated herein by reference. By using the Platform, you consent to the collection, use, and processing of your data as described therein, including storage and processing in the United States and other jurisdictions. Private Mode conversations are encrypted client-side and are cryptographically inaccessible to the Company.

Paid features are billed on a recurring basis. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. A 7-day money-back guarantee applies to your first subscription only. All other payments are non-refundable except as required by applicable law. Billing appears on statements under a discreet descriptor.

To the maximum extent permitted by applicable law: the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages; the Company's total liability shall not exceed the amount paid by you in the preceding 12 months or $100 USD, whichever is less; the Platform is provided on an AS IS and AS AVAILABLE basis with no warranties of any kind.

You agree to indemnify, defend, and hold harmless Lumara LLC and its affiliates from and against any and all claims, damages, liabilities, costs, and expenses including attorneys fees arising out of or related to your use or misuse of the Platform, your violation of these Terms, or any harm caused to yourself or others.

Any dispute arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding individual arbitration in the State of California. You waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative proceeding of any kind.

All AI-generated characters on this Platform are fictional and computer-generated. No actual human performers are depicted. This Platform is exempt from 18 U.S.C. 2257 record-keeping requirements as no actual human beings are depicted in any sexually explicit conduct. All characters are represented as adults aged 18 or older.

These Terms are governed by the laws of the State of California, United States. The Company may suspend or terminate your access at any time for any reason. Provisions relating to liability, waiver, indemnification, and dispute resolution survive termination. These Terms constitute the entire agreement between you and Lumara LLC regarding the Platform.
